1. Application of the General Terms and Conditions
These general terms and conditions apply to the mediation services provided by [Your Company Name] (hereinafter referred to as “the Mediator”) for the recruitment and selection of candidates. By using our services, the client (hereinafter referred to as “the Client”) agrees to these terms and conditions.
2. Definitions
- Candidate: The individual presented by the Mediator to the Client.
- Annual Salary: The candidate’s gross annual salary, including fixed and variable components such as bonuses and compensation for company car, as agreed in writing in the employment contract between the Client and the Candidate.
- Mediation Fee: The fee owed by the Client to the Mediator for the proposed candidate.
3. Mediation Fee
The mediation fee amounts to 25% of the candidate’s annual salary. This fee is due once the candidate enters into an employment contract with the Client.
4. Payment Terms
- The invoice for the mediation fee is issued at the time the employment contract between the Client and the Candidate is signed.
- The payment term is 30 days from the invoice date.
- In case of non-payment within the stipulated period, the Client will owe interest of 1% per month, as well as any collection costs.
5. Responsibilities of the Client
The Client is responsible for thoroughly assessing the candidate and making the final decision. The Mediator cannot be held liable for any shortcomings of the candidate.
6. Confidentiality
Both parties undertake to maintain confidentiality regarding all confidential information obtained within the framework of this agreement.
7. Applicable Law and Disputes
- This agreement is governed by Belgian law.
- Disputes arising from this agreement will be submitted to the competent court in the district where the Mediator is established.
8. Other Provisions
Changes to these general terms and conditions are only valid if agreed upon in writing by both parties.
